Oman is fundamentally transforming its landscape for international investors. Through the introduction of Regulation No. 81/2026, which implements Royal Decree No. 38/2025, the Sultanate has paved the way for non-Omani citizens to own real estate and secure residency without the need for a local sponsor.

A New Era of Property Ownership

Under the new framework issued by the Public Authority for Special Economic Zones and Free Zones (OPAZ), foreign nationals can now acquire freehold titles to both residential and commercial properties. This significant shift is specifically targeted at approved developments within key economic hubs.

The designated zones where these ownership rights are applicable include:

  • Duqm SEZ
  • Sohar Free Zone
  • Salalah Free Zone
  • Al Mazunah Free Zone

Breaking the Sponsorship Barrier

In a major departure from the traditional kafala system, residency visas will now be granted based on investment certificates or property ownership documentation. This change provides a much-needed pathway for long-term expatriates, retirees, and mid-size investors to live in the country independently of an employer.

Key features of this new residency model include:

  • Family Integration: The residency benefits extend to spouses and first-degree relatives, subject to standard immigration regulations.
  • Off-Plan Opportunities: Investors can utilize off-plan purchases to secure residency. For properties that are not yet registered, visas can be issued for six months to one year, with the possibility of renewal.
  • Enhanced Autonomy: The rules complement recent amendments to the Foreigners Residence Law, specifically designed to offer more stability to those residing in the Sultanate.

Strategic Incentives for Global Capital

To ensure these zones remain competitive on a global scale, OPAZ has introduced several high-value incentives for qualifying projects:

  1. Full Ownership: Investors can enjoy 100% foreign ownership of their businesses.
  2. Tax Advantages: The framework includes tax holidays to encourage long-term investment.
  3. Efficient Processes: Business licensing has been streamlined to reduce bureaucratic hurdles.
Prospective investors are advised to verify that a project is located within an OPAZ-regulated zone and to obtain an official ownership certificate prior to applying for residency.

It is important to note that these specific provisions are exclusive to the designated free zones. They do not apply to workers or residents operating outside these specified areas, who must continue to follow standard work-permit protocols and Omanisation requirements.
