Oman Unveils Strict New Recruitment Agency Regulations

The Oman Ministry of Labour has announced a comprehensive new regulatory framework for agencies involved in the recruitment of foreign workers, a move designed to enhance transparency and bolster the protection of expatriate labor. These Oman recruitment agency regulations are set to officially come into effect on January 1, 2027.

The new mandate was formalized via Ministerial Decision Number 390/2026, issued on October 11, 2026, by the Minister of Labour, Dr. Mahad bin Said bin Ali Ba'owain. This decision replaces previous licensing rules and introduces much stricter requirements for those operating in the recruitment sector.

Under the new rules, the landscape of recruitment agencies in Oman will change significantly. To ensure local control and accountability, the Ministry has stipulated that:

  • All recruitment activities must be conducted exclusively by agencies holding a valid license from the Ministry.
  • Agency ownership, partnerships, and the role of authorized signatories are now restricted solely to Omani citizens.
  • Agencies must provide a financial guarantee of RO 5,000 to obtain a license.
  • The licensing fee has been set at RO 300 for a two-year period.

While existing licenses will remain valid until they expire, all subsequent renewals must comply with these updated requirements.

Enhanced Protections for Expatriate Workers

A primary objective of the new regulations is to curb exploitation, particularly for the large population of Indian expatriates working in the Sultanate. The Ministry has introduced several safeguards to ensure fair treatment:

Agencies are strictly prohibited from charging any fees to the workers themselves. Furthermore, the responsibility for the welfare of the workers remains with the agencies; they are required to provide suitable accommodation and care for all workers under their supervision.

To ensure clarity before a worker arrives, the regulations mandate the following:

  • A formal job offer must be provided to the worker prior to recruitment.
  • This offer must detail the specific salary and the nature of the work.
  • Agencies must utilize standardized forms and integrated agreements to prevent discrepancies.
  • A mandatory two-year guarantee on all recruitment services must be provided.

Strict Recruitment Timelines

The Ministry is also implementing tighter controls on the speed of the recruitment process. Agencies are expected to complete recruitment procedures within 45 days. However, in specific circumstances, an extension of up to 30 days may be granted, provided that written consent is obtained.
